These Terms and Conditions apply to the use of the web site www.newsgrape.com (in the following "Newsgrape"). The provisions set forth herein apply to all persons who posts text, image files or other materials, using services made available (in the following "user"). Deviations or changes to these Terms and Conditions are only effective if expressly agreed in writing. Conflicting Terms and Conditions are not accepted by Newsgrape. The user expressly declares to have read these Terms and Conditions, to know their content and to submit to its provisions.
During the registration the user is obliged to submit all information completely and truthfully. Furthermore, the user agrees to handle the data submitted to Newsgrape during the registration confidentially, keeping it inaccessible to third parties. Once a user is informed about an unauthorized use of his personal log-in data he shall communicate this fact with Newsgrape immediately. The user takes full and personal responsibility for the use of Newsgrape and all the information and material uploaded in his name.
Newsgrape shall have the right to block the personal account of the user and thus exclude them from further use of the site, if
Newsgrape may terminate its relationship with the user at any time and delete the personal account, if the user has violated any provision of these Terms and Conditions, if Newsgrape is obligated by law or regulatory or legal decisions for deletion (for example, if the provision of the services by law is not permitted or will be) or if Newsgrape goes out of business for economic or other reasons. Moreover Newsgrape reserves the right to terminate the contractual relationship with the user at any time without notice for any reason at our sole discretion and to clear the personal account.

The user hereby accepts that all of the files provided are his own intellectual creation, or are subject to his right of usage. This applies particularly to texts, images and video. The user is responsible for all content on his publications. In particular, the user declares herewith that the property rights of third parties are not subject to publication unless expressly agreed to.
The use of other formats or content in his own name and is forbidden without the express written consent of the authorizing third party. It is further forbidden to use usernames or names incorrectly. A violation of this provision leads to the legal consequences of § 2 of these Terms and Conditions (exclusion from the platform and removal of personal account).
The user is also not allowed to transmit content to Newsgrape of which use or distribution is punishable by law, or pornographic, offensive, indecent or otherwise objectionable. The users created content represents solely their own opinions, and Newsgrape dissociates itself entirely from the contents. The responsibility for the content, accuracy, completeness and timeliness of the information reflected therein lies solely with the respective users.
Newsgrape allows user to publish advertisements on the platform. The user has to mark the published text as an advertorial with the checkbox during the publishing process. If the user violates this duty for the first time he will be informed. A repeated violation of the disclosure requirement leads to the legal consequences of § 2 of these Terms and Conditions (exclusion from the platform and removing of the personal account).
Newsgrape reserves the right to change the publications the user made available at our discretion, especially if they violate § 3 of these Terms and Conditions. In addition, Newsgrape reserves the right to delete publications at any time without giving reason.
The platform Newsgrape contains advertising and copywriting. Although Newsgrape tries to control these publications, the responsibility for their content lies within the publishing users. Newsgrape has no influence on this release and assumes no responsibility to users for any damages that arise from the fact that they rely on an article's accuracy, completeness, timeliness or availability of the publications.
The user hereby explicitly grants Newsgrape the right of reproduction, publication and utilization of the available content, such as for online magazines, RSS Feed Readers, e-mail newsletters, etc. The transfer of these powers shall be without charge, without condition and unlimited geographical coverage and scope, unless it is revoked by the user expressly and in writing. The user expressly agrees that uploaded files are stored on the server of Newsgrape. Newsgrape is granted the power to use the publications provided by the user in every way and pass them on to third parties in the same or modified form.
Newsgrape is usually operating 24 hours a day, 365 days a year available (the "uptime"). Excluded from the uptime are times when backups are performed and system maintenance and software maintenance happen, or work on the system or the database is performed. Newsgrape is entitled to perform such work during the operating period, and theret may be delays or disorders in databases. In addition, the functionality of Newsgrape depends on the proper functioning of the Internet services that are outside the control of Newsgrape. Disruptions or delays caused by unavailability of the website (for whatever reason) are not the responsibility of Newsgrape.
The information provided on Newsgrape may contain links to other websites which are not operated by Newsgrape and are not under the control of Newsgrape. Newsgrape assumes no liability for any such links listed there, or for the content contained or for the privacy practices or the functionality of other websites. The user hereby acknowledges that
If the user makes links in his publications, Newsgrape has the right to delete these links if the linked content violates § 3 of these Terms and Conditions or indicates the conditions for removal of content according to these Terms and Conditions.
Newsgrape assumes no liability and makes no warranty for the accuracy, correctness, quality, completeness and the credibility of the information or the users provided by any Newsgrape format. Newsgrape assumes no guarantee that the provided services operate continuously or flawless and compatible to all used formats. This disclaimer does not apply to cases in which users are injured by damage caused by an intentional or grossly negligent breach of duty of Newsgrape. If damages such as bodily harm caused by negligence or willful misconduct on the part of Newsgrape, Newsgrape is liable to the extent of the damage.
The user agrees to refrain from accessing, modifying, copying, deleting, or editing the software provided by Newsgrape. For any damage caused to Newsgrape by unauthorized editing the software the doer is liable to the extent of the damage.
Unless otherwise agreed to the user has the right to delete his personal account at any time without giving reasons. All publications provided to Newsgrape until this point remain the property of Newsgrape and thus may not be reproduced, published or used for other purposes and used in accordance with these Terms and Conditions.
